ChiroCare of Florida‘s INTERNET PRIVACY POLICY

This Privacy Policy applies to the ChiroCare of Florida website. The ChiroCare of Florida website contains links to other sites. Once you enter another website (whether through an advertisement, service, or content link), be aware that ChiroCare of Florida is not responsible for the privacy practices of such other sites. We encourage you to look for and review the privacy statements of each and every web website that you visit.

While you may use some of the functionality of ChiroCare of Florida without registration, many of the specific tools and services on our website require registration. If you use our website without registering, the only information we collect will be Non-Personal Information using Cookies. If you choose to become a member of our website, we require a limited amount of Personally Identifiable Information, such as your name, birth date and email address.

NON-PERSONAL INFORMATION WE COLLECT

Even if you do not register with ChiroCare of Florida, we collect Non-Personal Information about your use of our website, special promotions and newsletters.

ChiroCare of Florida assigns every computer a different Cookie. The information collected by Cookies:

  1. helps us to statistically monitor how many people are using our website
  2. how many people open our emails
  3. for what purposes these actions are being taken

Cookies are also used to facilitate a user’s log-in, as navigation aides and as session timers, but not to retain Personal Health Information about you.

PERSONALLY IDENTIFIABLE INFORMATION WE COLLECT

As you use ChiroCare of Florida, you will be given the option of receiving recurring informational/promotional newsletters via email. These emails will be of a general nature and will in no way disclose your unique health characteristics. At the time you sign up for our email newsletters or any time thereafter, you can choose to opt-out of receiving additional promotional emails from us.

To subscribe to such newsletters, we need your contact information, such as name and email address. You can unsubscribe from the newsletters by simply clicking on the “unsubscribe” link at the bottom of any email newsletter. An email to our automated unsubscribe service will be created on your computer. Click the “send” button. You will then be unsubscribed from that newsletter within two to three business days.

When you use ChiroCare of Florida‘s “Email a Friend,” ChiroCare of Florida emails the article or other content designated by you to your friend’s email address, listing your email address as the sender. ChiroCare of Florida uses the friend’s email address only for sending your friend the email you requested. While we store the email address, we do not use it for any other purpose.

This Privacy Policy does not protect you when you send content, questions or ideas to ChiroCare of Florida by email. If you want to keep them private or proprietary, do not send them in an email to ChiroCare of Florida. We try to answer every email within 48 business hours, but are not always able to do so.

After you have registered as a member of ChiroCare of Florida, you may choose to use certain interactive content, tools and services that may ask you to voluntarily provide other types of information about yourself including Personal Health Information. These tools do not retain or store your Personal Health Information.

We are committed to protecting the privacy of children. Neither ChiroCare of Florida nor any of its services are designed or intended to attract children under the age of 13.

From time to time the ChiroCare of Florida market research department, or its operations contractors acting on its behalf, conducts online research surveys in order to gather feedback about our site, our sponsors and opinions on important healthcare issues, through email invitations, surveys and online focus groups.

Personally Identifiable Information collected through market research will only be used by ChiroCare of Florida and its operations contractors and will not be given or sold to a third party.

MOBILE SMS COMMUNICATIONS

Opt-In and Consent: By providing your mobile phone number to ChiroCare of Florida through our website forms, patient intake documents, or verbally at any of our office locations, and by affirmatively agreeing to receive text messages (by checking an opt-in box, providing verbal consent, or texting a keyword to our designated number), you expressly consent to receive text messages (SMS) and multimedia messages (MMS) from us or our authorized service providers. Your consent is voluntary and not a condition of receiving healthcare services from ChiroCare of Florida—you may still receive our services even if you choose not to opt in to SMS communications. These messages may include appointment confirmations, appointment reminders, wellness tips, promotional offers, practice updates, health surveys, payment reminders, and other healthcare-related communications. Message frequency may vary depending on your appointment schedule and the services you select, typically ranging from 2-10 messages per month, though frequency may increase during active treatment periods. Standard message and data rates from your wireless carrier may apply. We do not charge for text messages, but your carrier’s standard messaging and data rates may apply to all messages sent and received. By opting in, you represent that you are the authorized user of the mobile phone number provided and that you have the authority to consent to receive text messages at that number.

Opt-Out and Privacy: You may opt out of receiving SMS communications at any time by replying “STOP” to any text message you receive from ChiroCare of Florida, or by contacting us directly at 877.388.2165 or at any of our office locations. Upon opting out, you will receive a one-time confirmation message confirming your unsubscribe request. After opting out, you will no longer receive promotional or non-essential SMS communications from us; however, we may still send critical appointment-related messages (such as same-day appointment confirmations or cancellations) unless you specifically request to opt out of all communications. You may re-subscribe at any time by texting “START” or by updating your communication preferences with our office staff. You may also text “HELP” for assistance or visit our website for more information. We respect your privacy and will not sell, rent, or share your mobile phone number with third parties for their marketing purposes. Your mobile phone number and related SMS information will be handled in accordance with this Privacy Policy and applicable HIPAA regulations governing Protected Health Information (PHI). We use industry-standard security measures to protect your information, but please be aware that standard SMS text messages are not encrypted and should not be considered a secure means of transmitting sensitive Personal Health Information. Data Security and Handling: ChiroCare of Florida takes the security of your mobile phone number and SMS communications seriously and implements appropriate administrative, technical, and physical safeguards to protect this information from unauthorized access, use, or disclosure. Your mobile phone number is stored securely in our HIPAA-compliant patient management systems and is accessible only to authorized personnel who require access to perform their job functions. We use reputable third-party SMS service providers who are contractually obligated to maintain the confidentiality and security of your information in compliance with applicable healthcare privacy laws, including HIPAA and the Telephone Consumer Protection Act (TCPA). However, you should be aware that SMS communications inherently carry certain security risks: text messages are transmitted through your wireless carrier’s network and may be stored on your mobile device, potentially making them accessible to others who have access to your phone. We strongly recommend that you password-protect your mobile device and delete sensitive messages after reading them. ChiroCare of Florida will never request sensitive personal information such as your Social Security number, credit card details, or detailed medical diagnoses via SMS. If you receive a suspicious message claiming to be from ChiroCare of Florida requesting such information, do not respond and contact our office immediately at 877.388.2165. We retain SMS communication records in accordance with applicable state and federal record retention requirements, typically for a minimum of seven years, and will securely dispose of this information when it is no longer needed for legitimate business or legal purposes. You have the right to request access to your SMS communication records or to request corrections to your mobile phone number by contacting our Privacy Officer at any ChiroCare of Florida location.

DISCLOSURE OF YOUR INFORMATION

Except as set forth in this Privacy Policy or as specifically agreed to by you, ChiroCare of Florida will not disclose any Personally Identifiable or Personal Health Information it gathers from you on our website. We will only release Personally Identifiable or Personal Health Information to third parties:

(i) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order.
(ii) in special cases, such as a physical threat to you or others. In the event that we are legally compelled to disclose your Personally Identifiable or Personal Health Information to a third party, we will attempt to notify you unless doing so would violate the law or court order. In addition, we may disclose Personal Information as described below.

CHANGES TO THIS PRIVACY POLICY

We will inform you if a material change to the Privacy Policy is made that involves the use of your Personally Identifiable Information. Your continued use of the ChiroCare of Florida site will indicate acceptance of the changes.
